Important: Please read these terms together with the details of the membership plan selected and the Club Rules. Keep a copy for your records.
1. About these terms
1.1 These terms apply to memberships supplied by New Fit Ltd, trading as Atrium Fitness, company number 14791412, whose registered office is 39 Newnham Street, Ely, Cambridgeshire, CB7 4PQ. In these terms, 'we', 'us' and 'Atrium Fitness' mean New Fit Ltd. 'You' means the member and, where relevant, the person responsible for paying for the membership.
1.2 These general terms should be read alongside the details of the membership plan selected at the time of joining and our Club Rules. If there is a conflict, the specific written terms of the selected membership plan will take priority.
1.3 By purchasing or using a membership, you agree to these terms and the Club Rules. Nothing in these terms affects your statutory rights.
2. Eligibility and membership
2.1 You must be aged 18 or over to purchase a membership. A person aged 16 or 17 may hold a membership only with the consent of a parent or guardian, who accepts responsibility for payments and the member's conduct.
2.2 We may ask for proof of age or identity and may refuse a membership application where we have a reasonable basis for doing so.
2.3 Your membership starts on the date stated when you join. It will be either a rolling monthly membership, an annual paid-in-full membership, or a fixed-term or promotional membership.
2.4 Membership is personal to the named member and cannot be shared, transferred or resold. You must not allow anyone else to use your membership, account or access card.
3. Membership fees and payments
3.1 The price, joining or enrolment fee, payment dates and services included in your plan will be shown before purchase.
3.2 The first payment and any joining or enrolment fee are payable when you join. Recurring fees are collected on the payment date stated in your membership agreement by Direct Debit or recurring card payment.
3.3 Membership fees remain payable whether or not you use the club, except where these terms or your statutory rights provide otherwise.
3.4 If a payment fails, we may try to collect it again using a payment method held on your account. We may suspend access while fees remain overdue.
3.5 Failed or unpaid payments may incur a reasonable administration charge reflecting the costs incurred by Atrium Fitness. Any fixed charge will be clearly stated before purchase.
3.6 If you raise an unjustified chargeback or payment reversal, we may recover reasonable costs actually incurred in investigating and responding to it.
4. Rolling monthly memberships
4.1 A rolling monthly membership continues until cancelled in accordance with section 9.
4.2 There is no minimum term unless a minimum term is clearly stated in the membership details provided before purchase.
5. Annual paid-in-full memberships
5.1 An annual paid-in-full membership runs for the period stated when purchased and ends on its stated expiry date unless renewed.
5.2 No cancellation notice is required. An annual paid-in-full membership will expire automatically on its stated expiry date unless it is renewed.
5.3 Annual memberships are normally non-refundable once they have started. We may consider early termination in exceptional circumstances, including long-term illness, serious injury or permanent relocation, subject to reasonable supporting evidence.
5.4 Where we agree to early termination, any refund may be calculated after deducting the period already used at the equivalent standard monthly rate and any non-refundable joining fee. This does not affect your statutory rights.
6. Fixed-term and promotional memberships
6.1 Fixed-term and promotional memberships run for the specific dates stated at the time of purchase. They provide access during that fixed period and are not based on the number of visits made.
6.2 These memberships cannot normally be frozen, paused, transferred or extended because of holidays, illness, injury, personal circumstances or non-use.
6.3 Payments are normally non-refundable once the membership has started, except where required by law.
6.4 Any extension, credit or alternative arrangement offered by Atrium Fitness is discretionary and does not create an entitlement to the same arrangement on another occasion.
7. Cooling-off rights for online and off-premises purchases
7.1 Where you purchase a membership online, by telephone or away from our premises, you will normally have 14 days from the day after the contract is made to cancel without giving a reason.
7.2 If you ask us to start providing the membership during the cooling-off period and then cancel, we may charge a proportionate amount for the service provided up to the date of cancellation.
7.3 The cooling-off right may be lost once a service has been fully performed, where you expressly requested early performance and acknowledged that consequence. To cancel during the cooling-off period, contact us using the details in section 17.
8. Freezing a membership
8.1 Rolling monthly and annual paid-in-full memberships may be frozen for up to three full months in any 12-month period, at our discretion.
8.2 A freeze must be requested in writing at least seven days before the proposed freeze date and must cover at least one complete month. Partial-month freezes are not available.
8.3 For a rolling monthly membership, no membership fee is due during an approved freeze and your payment method must remain active. For an annual paid-in-full membership, the expiry date will be extended by the length of the approved freeze. Access to the club is suspended throughout the freeze.
8.4 Fixed-term and promotional memberships cannot normally be frozen unless their specific plan terms say otherwise.
8.5 We will confirm the freeze dates in writing. A freeze is not agreed until that confirmation has been sent.
9. Cancelling a rolling monthly membership
9.1 You may cancel a rolling monthly membership by giving at least 14 days' written notice before your next payment date. Cancellation requests should be emailed to [email protected].
9.2 If fewer than 14 days remain before the next payment date, that payment will still be due and the membership will end immediately before the following payment date.
9.3 Cancelling your Direct Debit, card authority or payment method does not cancel your membership.
9.4 We will confirm cancellation in writing. If you do not receive confirmation, please contact us because your membership may remain active.
9.5 Outstanding fees remain payable. If you join again, the joining or enrolment fee applicable at that time may be charged.
9.6 In the event of a member's death, the membership will end immediately and no further membership fees will be due.
10. Prices and changes to membership
10.1 We may change recurring membership fees by giving at least 30 days' notice. If you do not wish to accept an increase, you may cancel before it takes effect by contacting us within the notice period, even where the usual 14-day cancellation deadline has passed.
10.2 We may make reasonable administrative changes to these terms. If a change materially disadvantages you, we will give reasonable notice and explain any cancellation right that applies.
11. Club access and conduct
11.1 You must scan in and out at reception on every visit and follow reasonable instructions from staff.
11.2 A photograph must be held on your membership account to confirm identity and prevent misuse. Personal information is handled in accordance with our Privacy Policy.
11.3 You must follow the Club Rules, behave respectfully and avoid conduct that threatens, harasses or disrupts other members, visitors or staff.
11.4 Allowing another person to use your membership may result in suspension or termination and recovery of any reasonable losses caused by the misuse.
12. Health, safety and participation
12.1 You must complete any required health questionnaire honestly and tell us about any relevant change that could affect safe participation.
12.2 You are responsible for exercising within your capabilities, using equipment correctly and seeking medical advice where appropriate. You must stop exercising and seek assistance if you feel unwell.
12.3 Members use the club and participate in exercise at their own risk and must follow staff instructions and club rules. Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence.
13. Facilities, opening hours and classes
13.1 Your access depends on the membership plan purchased. Some facilities, activities or services may require an additional payment or separate booking.
13.2 We may make reasonable changes to opening hours, class timetables, instructors, equipment and facilities. This may include temporary closure for maintenance, safety, refurbishment, public holidays or circumstances outside our reasonable control.
13.3 Short-term closures and individual class cancellations will not normally result in a refund. Where a significant facility is unavailable for an extended period, we will consider an appropriate remedy in light of the circumstances and your statutory rights.
13.4 Access and class places are subject to capacity and availability. Membership does not guarantee a place in a particular class or access to a particular item of equipment.
13.5 Class booking, cancellation and attendance rules are set out in the Club Rules and may be reasonably updated from time to time.
14. Personal belongings
14.1 You are responsible for your personal belongings while at the club. We are not responsible for loss, theft or damage unless caused by our negligence or where liability cannot lawfully be excluded.
14.2 Any lockers provided are for use only during your visit unless we expressly agree otherwise.
15. Suspension and termination by Atrium Fitness
15.1 We may suspend or terminate a membership where a member seriously or repeatedly breaches these terms or the Club Rules, behaves abusively, threatens safety, fails to pay fees, or misuses or shares a membership.
15.2 We will act reasonably and, where appropriate, tell you the reason and give you an opportunity to respond. Immediate suspension may be used where reasonably necessary to protect people, property or the operation of the club.
15.3 Refunds will not normally be made where termination results from the member's serious breach. This does not affect any statutory rights.
16. Matters outside our reasonable control
16.1 We will not be responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to reduce the effect of the event and restore services as soon as reasonably practicable.
16.2 Nothing in this section removes any remedy you may have where services cannot be provided for a significant period.
17. Contact and complaints
17.1 General enquiries, freeze requests, cancellations and complaints should be sent to [email protected] or delivered to Atrium Fitness, 39 Newnham Street, Ely, Cambridgeshire, CB7 4PQ.
17.2 We will investigate complaints fairly and aim to provide a written response within a reasonable period.
18. General
18.1 If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.
18.2 A delay by either party in enforcing a right does not mean that right has been waived.
18.3 These terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, although consumers living elsewhere in the UK retain any rights to bring proceedings in their home courts.
